How do I determine if I need a permit?

The best way to determine if you need a permit for your scope of work is to call the Permit Center at (574)296-9331, and we will be more than happy to guide you. Most building projects or renovation projects will require a building permit at a minimum, however, this list of common projects will provide you with some renovation projects that do not require a permit. Below are some common projects that will require a permit:

• Installation or replacement of shingles or metal roof (including overlays).
• Installation of a shed, pergola, or gazebo that is larger than 120 SF.
• Construction or replacement of most decks.
• Any work with the subfloor. 
• Building Additions.
• Swimming pools with a depth that is more than 2.5 feet (both above ground and inground pools).
• Installation or replacement of siding (over 100 SF).
• Installation or replacement of a fence.
• Installation or replacement of a driveway.
• Electrical work.
• Mechanical work.
• Plumbing work.

Why do we need permits?

Permits help protect property owners, contractors, and the City. They ensure that construction and improvements meet the standards established by the State of Indiana and the City of Elkhart, helping to maintain property values and safety. Permits may also be required for insurance claims or refinancing. In many cases, a zoning clearance is required in addition to a permit.

When are plans required to be filed with the State?

Who can apply for a permit?

The type of permit determines who is able to apply for it:

• Building Permits - Property Owner, Contractor, or other Authorized Agent
• Electrical Permits - Electrical Contractor who is properly licensed with the City of Elkhart
• Mechanical Permits - Mechanical Contractor who is properly licensed with the City of Elkhart
• Plumbing Permits - Plumbing Contractor who is properly licensed with the City of Elkhart
• Zoning Permits - Property Owner, Contractor, or other Authorized Agent

How long does it take to get a permit?

Permit process and review time varies depending on the type and complexity of the project. A permit for installing new shingles on your house can be issued in about 15 minutes. However, projects that require plans and review by other departments can take up to 5 business days.

What happens if I start work without a permit? 

Starting work without a required permit may result in a Stop-work order, penalty fees, and/or required inspections before work can continue. 

When does my permit expire?

A permit expires 1 year from the date of issuance. A one-time permit extension can be granted for an additional 1 year for a small fee.
