Fair Housing
What is Fair Housing?
Fair housing is the right to choose housing without being subjected to illegal discrimination. The cornerstone of fair housing protections is the federal Fair Housing Act, enacted in 1968 and enforced by the U.S. Department of Housing and Urban Development (HUD) and the City of Elkhart.
Federal Protected Classes
Under the federal Fair Housing Act, As Amended, it is illegal to discriminate based on the following protected characteristics:

Race

Color
-
National origin
-
Religion
-
Sex (includes gender)
-
Familial status (includes families with children under 18, pregnant women, and people in the process of adopting or fostering)

Disability (or handicap)
Prohibited Actions
The Fair Housing Act prohibits many actions if they are based on a person's protected characteristics, including:

Refusing to rent or sell a dwelling.

Refusing to negotiate for housing.

Making a dwelling unavailable.

Setting different terms or conditions for the sale or rental of a home.

Providing different housing services or facilities.
-
Falsely denying that housing is available for inspection, sale, or or rental.

Threatening, coercing, or intimidating anyone exercising their fair housing rights.

Advertising or making statements that indicate a discriminatory preference or limitation.

Practicing "blockbusting", which is persuading owners to sell or rent by telling them that people from a protected class are moving into the neighborhood.

Denying access to real estate services, such as a multiple listing service.
