What happens after a complaint is submitted?
A Code Enforcement Officer will review the complaint and inspect the property if needed.
What happens if a violation is found?
A notice will be issued outlining the violation and time to correct it.
How long does someone have to fix a violation?
The timeframe to correct a violation varies depending on the type of issue. Details will be included in the notice provided to the property owner.
What happens if the issue is not corrected?
The City may take additional enforcement actions, including:
- Fines or penalties
- Additional notices
- Legal action

What does Code Enforcement do?
Code Enforcement helps ensure that properties within the City of Elkhart are safe, maintained, and in compliance with local ordinances.
This includes addressing issues such as:
- Tall grass and weeds
- Trash and debris
- Unsafe or damaged structures
- Inoperable vehicles
- Property maintenance concerns
How do I report a code enforcement issue?
You can report issues through MyElkhart311, or by calling 311.
Reports may include:
- Overgrown grass or weeds
- Trash or debris
- Abandoned or inoperable vehicles
- Unsafe structures
Can I report an issue anonymously?
Yes. Reports can be submitted anonymously through MyElkhart311. You may also call 311 and have staff submit the request on your behalf.
Common Property Maintenance Requirements
What are basic property maintenance requirements?
All properties must be maintained in accordance with the City’s property maintenance code.
This includes:
- Structures must be kept in good repair (interior and exterior)
- All dwelling units must have working smoke detectors
- Address numbers must be visible from the street (minimum 3–4 inches tall)
How tall can grass and weeds be?
Grass, weeds, and vegetation must be kept under 8 inches in height.
What qualifies as trash or debris?
Trash, junk, and household items may not be stored outside, in yards, or on open porches. Outdoor furniture must be designed for outdoor use and kept in good condition.
Can I park vehicles on grass or dirt?
No. Vehicles may not be parked in front, side, or rear yards on unpaved surfaces.
Can I pave the tree lawn (area between the sidewalk and street)?
No. The tree lawn is part of the public right-of-way and generally may not be paved, covered, or altered without approval from the City.
What are the rules for parking vehicles on my property?
All vehicles must:
- Have current license plates
- Be operable
- Be parked on a paved or approved surface
Gravel is not allowed for new or expanded parking areas, and a permit is required for paving.
Are commercial vehicles allowed in residential areas?
No. Commercial vehicles and trailers are not permitted in residential zones if they meet certain size or weight criteria, including:
- Over 1.5-ton capacity
- Dual rear wheels or multiple axles
- Over 12 feet in length
Where can I store boats, RVs, or trailers?
Boats, RVs, campers, and noncommercial trailers must be stored on a paved surface beside or behind the home. On corner lots, they may not be stored on either street-facing side.
Who handles vehicles parked in the street, sidewalk, or alley?
Vehicles parked in the street, treelawn, sidewalk, or alley are enforced by the Police Department, not Code Enforcement.
What is an inoperable vehicle?
Vehicles that are not registered, not operable, or stored improperly on a property may be considered in violation.
Do I need address numbers on my house?
Yes. Address numbers must be clearly visible from the street and meet size requirements.
What is considered an unsafe structure?
Structures that are damaged, deteriorated, or pose a safety risk to occupants or the public may be considered unsafe.
Are farm animals allowed within City limits?
No. Farm animals are not permitted within the City of Elkhart. This includes, but is not limited to:
- Chickens
- Goats
- Ducks
- Other livestock
Can I blow grass clippings or leaves into the street?
No. Grass clippings and leaves should not be placed in the street.
Doing so can:
- Create hazardous driving conditions
- Clog storm drains
Placing yard waste in the street may result in a code violation and fines.
Can I leave tires at the curb for pickup?
No. Tires may not be placed at the curb, in alleys, or outside. They must be properly stored or taken to the Elkhart County Landfill.
Can I run a business from my home?
Most businesses (such as retail, food service, or auto repair) are not allowed in residential areas.
Some small home-based activities may be allowed if they:
- Are secondary to residential use
- Are conducted indoors by residents
- Do not create noise, traffic, odor, or other impacts
- Do not include signage or on-site sales
Can I run a business from my home?
Minor maintenance (such as oil changes or brake work) on your own vehicle is allowed. Major repairs (such as engine or transmission work) or working on vehicles for money is not permitted.
